TERMS AND CONDITIONS OF USE AND PRIVACY POLICY

Vitrine IA Québec is a web platform (the “Website”) developed by Forum IA Québec (“Forum IA Québec”, “we”, “us”, “our”) in collaboration with its partners to extend the reach of Quebec’s AI ecosystem in Quebec, elsewhere in Canada and abroad, to facilitate the connection between the key actors in the AI value chain as well as with businesses that wish to integrate AI into their operations, and to gather practical resources to encourage organizations to adopt AI.

The actors listed on and served by Vitrine IA Québec are found throughout the AI value chain and include, in particular, businesses offering AI-driven solutions (including B2B, B2G, and B2C business models), businesses offering AI advisory services, international leaders with an internal team fully dedicated to AI R&D based in Quebec (corporate laboratories), organizations dedicated to basic research, applied research or technology transfer and the dissemination of AI knowledge, financing and venture capital organizations specialized in AI, incubators and accelerators that support start-ups and technology entrepreneurs who depend on AI, and a variety of support organizations that contribute to AI ecosystem vitality, such as industry associations, research consortia, and public bodies.

By using the Website, accessing the “Enterprises Portal” or “Export Portal”, using any other services or tools offered (the “Services”) by Forum IA Québec, or downloading or accessing any documents from the Website, you are agreeing to these Terms and Conditions of Use and Privacy Policy (the “Terms and Conditions”) as a user, either on your own behalf or on behalf of a person you represent (the “User”, “you”, “your”).

The Terms and Conditions are subject to change at any time without notice. It is therefore recommended that you refer to them regularly. If you do not agree to be bound by the Terms and Conditions, you are not authorized to use the Website and must discontinue your use of it.

 

1. LINKS TO THIRD-PARTY WEBSITES

The Website contains links that allow the User to access websites operated by third parties. These links are made available for the User’s convenience only and to provide the User with a more intuitive, enjoyable browsing experience. The existence of such links does not constitute an implicit or explicit endorsement of such websites, their content or any linked websites, and Forum IA Québec cannot be held liable for their content or for any damage or loss resulting from their use. Forum IA Québec is free at all times to remove or change any links appearing on the Website or to add new links. Information exchanged through these other websites is not subject to these Terms and Conditions. We therefore recommend that you read, in particular, the privacy policies in force for these websites. Forum IA Québec bears no liability for the selection of links provided.

 

2. INTELLECTUAL PROPERTY

2.1. Certain names, words, titles, expressions, logos, icons, graphics, designs or other content appearing on the pages of the Website or in Forum IA Québec communications are commercial designations or trademarks held by Forum IA Québec or commercial designations or trademarks that Forum IA Québec is permitted or licensed to use. These elements and any other material on the Website or in Forum IA Québec communications are protected by intellectual property legislation, including copyright.

2.2. Any unauthorized downloading, retransmission, copying or modification of trademarks, images, text or data contained within the Services may contravene legislation and subject the User to legal proceedings.

2.3. Other than for Internet browsing needs, and unless otherwise indicated, it is strictly prohibited to copy, redistribute, reproduce, republish, store in any media, retransmit or modify the information contained on the Website or to make public or commercial use thereof, in any form whatsoever. 

 

3. LINKS TO THE WEBSITE

The Website may be among links provided on third-party websites. Forum IA Québec is not liable for the content of any related websites or any links on such websites. The fact that links to the Website exist does not mean that Forum IA Québec supports, approves or otherwise recognizes the content of any such website or any links present on any such website.

 

4. USER ACCOUNT

4.1 As a User creating an account to access the “Export Portal” or the “Enterprises Portal” through the page of the Website provided for this purpose (the “Account”), you must (i) be a person of full age in your jurisdiction, (ii) have the legal capacity to consent to the Terms and Conditions, and (iii) provide accurate and current information and immediately notify Forum IA Québec, through the Website, of any changes to the information provided when creating the Account or thereafter. Any processing or use of this information will be carried out in accordance with the Terms and Conditions.

4.2 Only the User is authorized to use their Account. The User is also solely responsible for maintaining the confidentiality of their personal identifiers, and Forum IA Québec is not liable for any access to or use of the Account by anyone other than the User of the Account, including when a User inadvertently or otherwise discloses all or any part of their personal identifiers, uses software or tools that permit automatic entry of personal identifiers, or otherwise saves, records, or documents all or part of their personal identifiers.

 

5. USER UNDERTAKINGS

5.1 In connection with your use of the Website and any Account, you agree and undertake to

  • Not use the Website or the Services in an illegal manner or in a manner other than in accordance with the instructions of Forum IA Québec;
  • Comply with the Terms and Conditions and the policies issued occasionally by Forum IA Québec, which may be modified without notice;
  • Provide accurate and current information to Forum IA Québec;
  • Ensure, at all times, that all information accessible through the Website or the Services related to the User (including any person they represent), is accurate and current;
  • Not provide or transmit on or through the Website any inappropriate content, whether through the use of a pseudonym, by chat or otherwise;
  • Solely bear liability for your computers and any damage that may result from their use; and
  • Not challenge, directly or indirectly, or assist in challenging the ownership of Forum IA Québec’s intellectual property or the validity of its intellectual property rights.

5.2 Forum IA Québec may, at its discretion and, in particular, in the event of use that does not comply with the Terms and Conditions, take any measures deemed appropriate, including refusal to create an Account or suspending, deactivating, closing or deleting an existing Account. Forum IA Québec reserves the right to claim any damage or loss that Forum IA Québec may suffer as a result of the acts or omissions of a User, subject to its other forms of recourse.

 

6. ACCURACY OF INFORMATION

Forum IA Québec offers no guarantee and disclaims all liability for any content provided or transmitted by any User or any other person, including the accuracy, timeliness or reliability of such content. Forum IA Québec reserves the right to remove any content or information if it is brought to the attention of Forum IA Québec that information or content provided or transmitted by the User or any other person is inaccurate or misleading, and Forum IA Québec will not incur any liability in this regard. 7. AUTOMATICALLY EXCHANGED DATA

7.1 When a User accesses the Website, their computer and the servers of Forum IA Québec or its providers automatically exchange data. This exchange is necessary for the server to transmit a file compatible with the User’s computer equipment.

7.2 The following data is exchanged:

  • The User’s Internet service provider;
  • The User’s IP address;
  • The type of browser and operating system used by the User;
  • The pages that the User visits;
  • The date and time the User is accessing the Services; and
  • The address of the referring website, if the User accessed the Website by means of another website.

Information shared automatically between computers does not reveal the identity of a User. It is only collected because of technological requirements inherent to Internet browsing and for statistical purposes.

 

8. GOOGLE ANALYTICS

Forum IA Québec uses Google Analytics on the Website to obtain statistics and reports on Website navigation to improve User experience. User data is used in accordance with Google’s Privacy & Terms, which can be found at https://policies.google.com/technologies/partner-sites?hl=en.

 

9. USE OF COOKIES

Cookies are used to facilitate navigating the pages of the Website. These cookies do not collect personal information about Users. A User may at any time set their browser to prohibit the use of cookies. However, this action may restrict the User’s access to certain Website features.

 

10. PERSONAL INFORMATION 

Forum IA Québec is concerned about the privacy and protection of personal information of its Users. Personal information refers to any information that identifies an individual. Forum IA Québec will honour its commitments under these Terms and Conditions with respect to the personal information of its Users, in accordance with legislation.

10.1 Collection of personal information

The Website does not feature any technology that collects personal information about the User against their will. The User is free to use the Website without having their personal information automatically collected.

No personal information is collected unless the User has given prior consent. The only personal information that can be collected by Forum IA Québec is the information that the User voluntarily provides to Forum IA Québec, whether in the context of signing up and creating of an Account or modifying Account information, by sending it directly to an email address listed on the Website, or in any other manner. If you provide us with personal information about other individuals, you must ensure that you have duly notified them and obtained their consent for such a disclosure.

10.2 Use of personal information

Personal information is processed and stored in accordance with legislation. This means that, unless otherwise provided by law, Forum IA Québec will seek the User’s consent prior to any use of the User’s information for purposes other than those for which the User provided it.

Personal information can be accessed by

  • Employees and representatives of Forum IA Québec, when necessary for the performance of their duties;
  • Forum IA Québec’s web administration and hosting providers; and
  • The Ministère des Relations internationales et de la Francophonie (the “MRIF”) and its partners, subject to the Act respecting access to documents held by public bodies and the protection of personal information.

The information is gathered to

  • Verify eligibility for the Services requested by the User, including the creation of an Account;
  • Provide the Services requested by the User;
  • Register the User for an event or subscribe the User to a newsletter;
  • Process an online payment;
  • Process all requests for information;
  • Comply with legislation or an order by a competent authority;
  • Verify whether the User is in compliance with the Terms and Conditions and legislation; or
  • Compile statistics.

10.3 Disclosure of personal information

Forum IA Québec may disclose personal information when required under legislation or by order of a competent authority. Forum IA Québec may also disclose personal information to service providers, including service providers located outside of the province of Quebec and of Canada.

10.4 Retention and destruction of personal information

Forum IA Québec and its authorized suppliers implement security measures to ensure the protection of Users’ personal information.

Personal information is securely and confidentially destroyed (a) at the User’s request, in which case the User understands that their Account will be deleted, and (b) within a reasonable period of time after a User’s Account is closed.

10.5 Right to access and rectify information

Every User has the right to access personal information about them that is under the control of Forum IA Québec. If any information is inaccurate, incomplete or ambiguous, the User may request in writing that it be corrected. To access personal information under the control of Forum IA Québec, you must send Forum IA Québec a request by using the contact information in the “Additional and Contact Information” section of these Terms and Conditions.

 

11. CONFIDENTIAL INFORMATION

When an Account is created through the “Enterprises Portal”, you may choose to share with Forum IA Québec certain privileged, confidential information about your business and its corporate affairs. This information may include specifics about finances, strategic planning, industrial and marketing research findings, trade secrets, technical data, know-how and, in general, confidential, privileged business information that is not known to the market or the public relating to your business and its corporate affairs (collectively, “Confidential Information”). The Confidential Information that you share with us is handled in a manner that maintains its confidentiality, in particular by means of Forum IA Québec entering into confidentiality agreements with those who have access to such Confidential Information.

CONFIDENTIAL INFORMATION MUST EXCLUSIVELY BE SHARED IN THE “Confidential Information” SECTION OF THE ENTERPRISES PORTAL. ANY INFORMATION THAT IS NOT SHARED IN THIS MANNER COULD BE MADE PUBLIC AND ACCESSIBLE TO ANY USER.

The Confidential Information you choose to share with Forum IA Québec can be accessed by

  • Employees and representatives of Forum IA Québec, when access to the Confidential Information is necessary for the performance of their duties;
  • Forum IA Québec’s web administration and hosting providers;
  • Forum IA Québec’s consultants and providers of data processing and statistical compilation services; and
  • The MRIF and its partners.

You are not authorized to share Confidential Information with Forum IA Québec, through the Services or otherwise, unless you consent to Forum IA Québec sharing such Confidential Information with those identified above.

 

12. LIMITATION OF LIABILITY

In addition to the other limitations of liability included in the Terms and Conditions, Forum IA Québec and its officers, directors, employees, and representatives are not, under any circumstances liable, whether in civil matters or otherwise, for any loss or damage of any kind incurred in connection with browsing, using, or not being able to access the Services, including in the event of (i) failure, malfunction or destruction of computer systems used in connection with the Services, (ii) a delay or lag, no matter the cause, which prevents anyone from creating or accessing an Account, and (iii) any failure, delay or other similar circumstance attributable to any third party involved in providing the Services, including all providers of services and telecommunications equipment related to the Services.
